Refund Policy

1. Definitions
For the purposes of this Refund Policy, the following terms shall have the meanings set forth below:
1.1 “iLANTIX”, “we”, “us”, or “our” means iLANTIX LLC, a Texas limited liability company.
1.2 “Platform” means the iLANTIX website located at ilantix.com, its associated subdomains, mobile applications, and all related services.
1.3 “Organizer” means any person or entity that creates, publishes, or sells tickets to an Event through the Platform.
1.4 “Buyer” means any person who purchases a Ticket through the Platform.
1.5 “Event” means any occasion, gathering, or activity for which an Organizer offers Tickets through the Platform.
1.6 “Ticket” means any admission credential purchased through the Platform, including general admission, reserved seating, table reservations, and package tickets.
1.7 “Ticket Price” means the face value of a Ticket as set by the Organizer, exclusive of the Platform Fee, payment processing fees, and any applicable taxes.
1.8 “Platform Fee” means the per-Ticket fee charged by iLANTIX, being two percent (2%) of the Ticket Price plus ninety-nine cents ($0.99) per Ticket.
1.9 “Non-Refundable Ticket” means a Ticket belonging to a ticket type that the Organizer has designated as non-refundable through the Platform, which designation is displayed to the Buyer at the point of purchase.
1.10 “Event Start Time” means the commencement date and time of the Event as published by the Organizer.
2. Nature of the Platform and limitation of iLANTIX’s role
2.1 iLANTIX operates strictly as a ticketing intermediary and technology provider. iLANTIX is not the seller, producer, promoter, or host of any Event listed on the Platform.
2.2 All payments for Tickets are processed directly to the Organizer’s own connected payment account. iLANTIX does not hold, retain, escrow, control, or take custody of Ticket proceeds at any time.
2.3 Consequently, iLANTIX is not able to issue refunds to Buyers and expressly disclaims any liability or obligation with respect to the issuance, timing, or amount of any refund. All refund obligations set forth in this Policy are obligations of the Organizer.
2.4 Nothing in this Section limits any right a Buyer may have against an Organizer, or any right or remedy available under applicable law that may not lawfully be excluded or limited.
3. Standard refund right
3.1 Refund window. Except where Section 3.3 applies, a Buyer may request a refund of the full amount paid at any time up to and including thirty (30) days prior to the Event Start Time, and the Organizer shall honour such request.
3.2 Requests within thirty days. Where a refund is requested less than thirty (30) days prior to the Event Start Time, the granting of such refund shall be at the sole discretion of the Organizer, except where Section 4 or Section 5 applies.
3.3 Non-Refundable Tickets. Where an Organizer has designated a ticket type as a Non-Refundable Ticket, the refund right set forth in Section 3.1 shall not apply to Tickets of that type. Such designation:
(a) shall be displayed conspicuously to the Buyer on the checkout page prior to the completion of purchase;
(b) shall not operate to limit, waive, or otherwise affect the Organizer’s obligations under Section 4 (Cancellation) or Section 5 (Postponement); and
(c) shall not operate to limit any right or remedy available to the Buyer under applicable law that may not lawfully be excluded or limited.
3.4 Manner of request. Refund requests under this Section shall be directed to the Organizer using the contact information published on the Event page.
4. Cancellation of an Event by the Organizer
4.1 In the event that an Organizer cancels an Event, the Organizer shall refund to each Buyer the full amount paid by that Buyer, inclusive of the Ticket Price, the Platform Fee where borne by the Buyer, and any payment processing fees and taxes charged at checkout.
4.2 The obligation set forth in Section 4.1 applies:
(a) irrespective of when the cancellation occurs, including where cancellation occurs within thirty (30) days of the Event Start Time; and
(b) irrespective of whether the affected Tickets were designated as Non-Refundable Tickets.
4.3 Platform Fee not returned. Where an Event is cancelled by the Organizer, the Platform Fee shall be retained by iLANTIX and shall not be returned to the Organizer. The Organizer shall bear the cost of that fee in refunding the Buyer in full.
4.4 For the avoidance of doubt, iLANTIX’s retention of the Platform Fee reflects services already rendered in facilitating the sale, issuance, and delivery of Tickets, which services are not undone by the cancellation of the Event.
5. Postponement or rescheduling of an Event
5.1 In the event that an Organizer postpones or reschedules an Event, each Buyer may elect either:
(a) to retain their Ticket, which shall remain valid for the rescheduled Event; or
(b) to request a refund of the full amount paid.
5.2 Where a Buyer elects the option set forth in Section 5.1(b), the Organizer shall honour that request. This obligation applies irrespective of when the request is made and irrespective of whether the affected Tickets were designated as Non-Refundable Tickets.
5.3 The provisions of Section 4.3 (retention of the Platform Fee) shall apply equally to refunds issued under this Section.
6. Transferred tickets
6.1 An Organizer may, at their discretion and upon request, transfer a Ticket to a person other than the original Buyer, whether by amending the attendee name or by reissuing the Ticket to a different email address.
6.2 Where a Ticket has been transferred, the refund right set forth in Section 3.1 shall no longer apply to that Ticket, irrespective of the time remaining before the Event Start Time.
6.3 The Organizer’s obligations under Section 4 (Cancellation) and Section 5 (Postponement) are unaffected by a transfer and continue to apply.
6.4 Any refund in respect of a transferred Ticket shall be made to the original method of payment used by the original Buyer. iLANTIX and the Organizer are not able to direct a refund to a transferee who did not make the original payment.
6.5 Transfers are arranged directly with the Organizer. Buyers may not transfer Tickets independently through the Platform.
7. Manner and timing of refunds
7.1 Refunds are initiated by the Organizer through the Platform and are disbursed from the Organizer’s connected payment account.
7.2 Refunds are returned to the original method of payment. Buyers should allow five (5) to ten (10) business days for a refund to appear, such timing being determined by the Buyer’s financial institution and not by iLANTIX or the Organizer.
7.3 Where a Ticket is refunded, that Ticket shall be rendered invalid and shall not permit admission to the Event.
7.4 Partial refunds. Where an order comprises multiple Tickets, an Organizer may issue a refund in respect of some but not all Tickets in that order. Tickets that are not refunded shall remain valid.
8. Organizer obligations and suspension
8.1 The refund obligations set forth in Sections 3, 4, and 5 are binding obligations of the Organizer, accepted by the Organizer upon registration for the Platform and upon each publication of an Event.
8.2 Failure by an Organizer to honour a refund obligation under this Policy may constitute grounds for suspension or termination of that Organizer’s access to the Platform in accordance with the iLANTIX Terms of Service.
8.3 Suspension or termination of an Organizer’s access to the Platform does not extinguish, satisfy, or transfer to iLANTIX any refund obligation owed by that Organizer to a Buyer.
9. Chargebacks and payment disputes
9.1 Buyers are encouraged to seek resolution directly with the Organizer prior to initiating a chargeback or payment dispute with their financial institution.
9.2 Where a chargeback is initiated, the resulting dispute is between the Buyer, the Organizer, and the relevant payment processor. iLANTIX does not hold the disputed funds and is not a party to such dispute.
10. General provisions
10.1 Statutory rights preserved. Nothing in this Policy operates to exclude, restrict, or modify any right or remedy conferred upon a Buyer by applicable law where such exclusion, restriction, or modification would be unlawful.
10.2 Amendment. iLANTIX may amend this Policy from time to time. The Policy in force at the time a Ticket is purchased shall govern that purchase.
10.3 Conflict. In the event of a conflict between this Policy and any refund terms published by an Organizer, this Policy shall prevail to the extent of the inconsistency, save that an Organizer may offer terms more favourable to the Buyer than those set forth herein.
10.4 Severability. If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.5 Governing law. This Policy shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
